After the Authors Guild filed suit against HathiTrust's orphan works plan, AG members discovered some of the candidates on the orphan list were in fact not orphans. The University of Michigan has since suspended the orphan release to improve its processes. But, in our concern over whether or not any given work might be located, notes Peter Brantley, we risk a "trees-and-forest misdirection." It it is safe to assert that there are many works for which rights status is uncertain and must be clarified, he notes, and rather than focus on the status of the 140 individual titles in the HathiTrust plan, we should focus on how we can make the determination of rights status more efficient.
