Kaplan Sues Princeton Review

Test preparation publisher Kaplan Educational Centers has filed a lawsuit against its competitor The Princeton Review, claiming that The Princeton Review uses false advertising claims. Kaplan is seeking injunctive relief and compensatory and punitive damages. Random House, parent company of the Princeton Review, is also named as a defendant, along with Mindscape, a multimedia unit of Random House.
Kaplan claims that the Princeton Review's test preparation book Cracking the GMAT CAT 1998 Edition claims to have "four computer-adaptive tests on CD-ROM," when it really only includes one test.

Peter Degiglio, v-p and publisher of the Princeton Review, called the suit "laughable. There is a copyediting error on the cover. This happens in test preparation publishing. We have revised the cover, and a reprint is being shipped now." Degiglio said the GMAT CAT book is "a hot title and we've been in the market awhile. This is how Kaplan responds."

Kaplan CEO Andy Rosen told PW the Princeton Review's falsely labeled products are unfair competition and that "reprinting is inadequate. There are thousands still on the shelves that will disappoint students once they get the product home."
